An Express Law Protected Property Trust Will enables you to safeguard your property and ensure it goes where you want it to go when you die. The trust is activated on first death.

The surviving partner has a right of residence in the property for the remainder of their life. They cannot be evicted by other trustees and if later in life they want to sell the property, buy somewhere else and release some equity they are free to do so.

An Express Law Protected Property Trust Will severs 'joint tenancy' creating 'tenants in common' enabling each owner to do what they want with their own half.

If the surviving partner goes into care and an assessment is made they will not be able to take into account any of the property already in trust, thus protecting it for future beneficiaries.

Act NOW as the sooner you protect your home the better – do not wait until it is too late.

No work should be instructed to deliberately avoid care fees as this would be depravation of assets. From CRAG 2011 “The Local Authority may consider that a resident has deprived himself of a capital asset in order to reduce his accommodation charge. If this is the case the Local authority may treat the resident as still possessing the asset.”
